By your indication below and by participating in the CompleteCase.com Affiliate Program, you agree, without limitation or qualification, to be bound by, and to comply with, these Terms and Conditions and any other posted guidelines or rules applicable to any Emit, Inc. (d/b/a CompleteCase.com) web site, Product or Service. All such guidelines and rules are hereby incorporated by reference into these Terms and Conditions. The purpose of the relationship between you and Emit, Inc. (d/b/a CompleteCase.com) is for the referral of potential customers to Emit's website located at www.completecase.com and for Emit to pay you where those referred individuals become paying customers of Emit. You shall use reasonable efforts to refer individuals to www.completecase.com. Where an individual pays for an online divorce and where that person comes to www.completecase.com via a link from your website, Emit shall pay you a referral fee totalling 15% of the gross amount of sale. No payment shall be due for returns, credits or uncollectable amounts. Payment shall be made within 30 days after the end of each calendar month. You agree not to compete with Emit, Inc. (d/b/a CompleteCase.com) by providing divorce forms' completion services through the internet to end users outside of the relationship between yourself and Emit, Inc. These Terms and Conditions supersede any and all prior representations, conditions, warranties, understanding, proposals or previous agreements between you and Emit, oral or written, relating to the subject matter hereof and constitutes the complete agreement between the parties. Should any of the provisions of these Terms and Conditions found to be invalid by any court of competent jurisdiction, that portion shall be deemed severed or restricted and the remainder of this Agreement shall remain in full force and effect. If any action or proceeding shall be commenced to enforce or interpret these Terms and Conditions or any right arising in connection with them, the prevailing party in such action or proceeding shall be entitled to recover from the other party, all reasonable attorneys' fees, costs and expenses incurred by such prevailing party in connection with such action or proceeding. Any action or proceeding shall be maintained in Seattle, Washington. Either you or CompleteCase.com can stop their participation in the agreement at anytime. If CompleteCase.com terminates the agreement, all payments due to you will be made. I agree to be bound by these Terms and Conditions.
